Printing
Industries of America, Inc. and the National Association for Printing
Leadership set up a joint committee including a representative from Idealliance
(formerly Graphic Communications Association) to review current business
practices and terms and conditions of sale. These best practices have been
adopted by Wet Ink Printing & WetInkPrinting.com.
Ordering & Terms of Sale
Any order
(internet, email, phone, fax or walk-in) to manufacture and produce a printed
product is a binding contract for payment. Full
payment, including shipping and handling is required with order. No work will
proceed until payment is received. No refunds are given once your order has
been verified. No partial refunds for work not completed. Postage is due in
full before delivery to the Post Office.
Acceptance of order shall
not be effective until acceptance by supplier. Acceptance by supplier may be
either by notification to client or by commencing to produce work on the
merchandise ordered. Canceled orders require compensation for incurred cost and
related obligations.
Refund
Policy
All
sales are final. No refunds are available on orders unless no files have been
sent to press and the refund is requested the same business day. In the case of
a refund on an order that work has not started, a $15 processing fee will be
charged.
Quotes & Accuracy
of Specifications
Quotations are
based on the accuracy of the specifications provided. The supplier can re-quote
a job at time of submission if copy, film, tapes, disks, or other input materials
do not conform to the information on which the original quotation was based. A
quotation not accepted within 30 days may be changed.
File
Requirements
All
images, after being enlarged or reduced for reproduction, will crop
approximately 1/16" to 1/8" to allow for bleed. See the Digital
Checklist for more details. We cannot process orders that do not meet the
minimum requirements.
It is the client's
responsibility to maintain a copy of the original file. The supplier is not
responsible for accidental damage to media supplied by the client or for the
accuracy of furnished input or final input. Until digital input can be
evaluated by the supplier, no claims or promises are made about the supplier's
ability to work with jobs submitted in digital format, and no liability is
assumed for problems that may arise. Any additional translating, editing, or
programming needed to utilize client-supplied files may be billable.
Proofs
A color proof is
used to simulate how the printed piece will look. Because of differences in
equipment, paper, inks, and other conditions between color proofing and
production pressroom operations, a reasonable variation in color between color
proofs and the completed job is to be expected. When variation of this kind
occurs, it will be considered acceptable performance and the proof becomes a
contract between the client and supplier.
Wet Ink
Printing will reproduce color from submitted transparencies, slides, photos, or
digital layouts as closely as possible, but cannot exactly match color and
density (as viewed in a 5000K light booth) because of limitations in the
printing process, as well as neighboring image ink requirements. The accuracy
of each color reproduction is guaranteed to be within 85-95% of the original
image you submitted. We accept no responsibility for color variations between
submitted images and the actual artwork or product they represent.
You are 100%
responsible for the accuracy of your layouts & digital files. If your file
is not submitted properly Wet Ink Printing cannot be held responsible. We will
not double-check your files!! Please proofread all layouts carefully. As postal
regulations are subject to change, you are also 100% responsible for complying
with current mailing restrictions for postcard backside layouts. Check with
your local Post Office.
Shipped orders
that were submitted with a color proof that are not resembling the color and/or
positioning on the final proof will be rerun at no charge. We have the final
judgment as to what accuracy range is possible to match the color proof.
Changing files
that have been sent to press: As a courtesy to our customers, Wet Ink Printing
allows replacement of files sent to the press but not yet printed depending on
the job status:
At Prepress: 1
free incident of replacing files per order, turnaround time reset based on the
time the replacement files are received by Wet Ink Printing.
Ready for
Press: Once we have checked your file and it is ready for press we cannot
accept replacement files beyond this point.
Turnaround
Times
Turnaround
time does not begin until acceptable artwork has been provided and verified.
Please note that if we are unable to print your files because they do not
conform to our file requirements, your order status will return to "job
pending file" and your turnaround time will be reset. If you order a hard
copy proof, turnaround begins when we receive the proof approval returned.
Allow additional business days for delivery based on the shipping method you
selected.
Business days
are Monday through Friday. Holidays, Saturdays and Sundays do not count when
calculating turnaround.
Production
& Delivery Schedule
Quoted
turnaround times start when we verify your order, provided we have the artwork
needed to print, not from when the order is first submitted. Turnaround times
vary and are not guaranteed. Wet Ink Printing assumes no responsibility for
delays caused by delivery carriers or any damages resulting from the failure to
receive a job on time. Our expected delivery date is not guaranteed. There will be no liability or
penalty for delays due to unforeseen delays in
delivery service, the breakdown of equipment, power outages, illness, state
of war, riot, civil disorder, fire, strikes, accidents, action of government or
civil authority, acts of God, or other causes beyond the control of the
supplier. In such cases, schedules will be extended by an amount of time equal
to delay incurred. You should check your order status
online, as it will be updated frequently.
Over-runs or
Under-runs
Over-runs or under-runs will not exceed the percentage specified in the
contract. The supplier will bill for actual quantity delivered within this
tolerance. If the client requires a guaranteed quantity, the percentage of
tolerance must be stated at the time of quotation.
Shipping
Our online shipping prices are valid within the continental United States (48 states). Shipping to Alaska and Hawaii may be a bit more expensive. We are also able to accommodate for international orders, but you MUST contact us to arrange shipping method and options. We are not responsible for any customs forms, tariffs, taxes or fees for any international order. We work with trucking lines and can arrange for freight delivery for extremely large (and heavy) orders at reasonable prices.
All orders are inspected, packed, & sealed tightly & securely before they leave our shipping area. Wet Ink Printing is not responsible for any damage to packages, mishandling, loss, or delays by the carrier. Insurance must be purchased with the print order by the buyer. Wet Ink Printing does not automatically insure shipped packages. Orders shipped by Air Cargo must be picked up at the airport! Delivery to your door may be available with select carriers, but must be discussed with a customer service representative when you place your order. Air Cargo shipping charges must be paid upfront and are subject to additional airport delivery fees.
Risk of Loss
All items
purchased from Wet Ink Printing are made pursuant to a shipment contract and will
be delivered to a carrier, unless picked up by the customer. Risk of loss and title for such items pass to
the buyer upon our delivery to the carrier.
Complaints
All
complaints must be registered with in 24 hours of receipt of job. Should the
job contain manufacturing errors and/or defects, we would rerun the job at no
charge. We maintain the right to judge what a manufacturing error and defect
is.
Sales Tax
All California orders are
subject to sales tax. If customer is tax exempt, exemption certificate must be
sent or faxed to us with to first job. Thereafter, your account will reflect
tax-exempt status.
Indemnification
The client agrees to protect the supplier, Wet Ink Printing, from economic loss
and any other harmful consequences that could arise in connection with the
work. This means that the client will hold the provider harmless and save,
indemnify, and otherwise defend him/her against claims, demands, actions, and
proceedings on any and all grounds. This will apply regardless of responsibility
for negligence.
Copyrights: The client warrants that the subject matter to be printed is
not copyrighted by a third party. The client also recognizes that because
subject matter does not have to bear a copyright notice in order to be
protected by copyright law, absence of such notice does not necessarily assure
a right to reproduce. The client further warrants that no copyright notice has
been removed from any material used in preparing the subject matter for
reproduction. To support these warranties, the client agrees to indemnify and
hold the supplier harmless for all liability, damages, and attorney fees that
may be incurred in any legal action connected with copyright infringement
involving the work produced or provided.
Personal or economic rights: The client also warrants that the work does
not contain anything that is libelous or scandalous, or anything that threatens
anyone's right to privacy or other personal or economic rights. The client
will, at the client's sole expense, promptly and thoroughly defend the supplier
in all legal actions on these grounds as long as the supplier promptly notifies
the client of the legal action and gives the client reasonable time to
undertake and conduct a defense. The supplier reserves the right to use his or her
sole discretion in refusing to print anything he or she deems illegal,
libelous, scandalous, improper, or infringing upon copyright law.
Liability
Disclaimer of Express Warranties: The supplier warrants that the work is
as described in the purchase order. The client understands that all sketches,
copy, dummies, and preparatory work shown to the client are intended only to
illustrate the general type and quality of the work. They are not intended to
represent the actual work performed.
Disclaimer of Implied Warranties: The supplier warrants only that the
work will conform to the description contained in the purchase order. The
supplier's maximum liability, whether by negligence, contract, or otherwise,
will not exceed the amount specified in the contract. Under no circumstances
will the provider be liable for specific, individual, or consequential damages.
Material
and Samples
All
materials we create in producing your job are the property of Wet Ink Printing.
These materials will not be sold or given to any other party. We reserve the
right to distribute free samples of your postcard and use your artwork in our
advertising.
Terms/Claims/Liens
It is customary in
the industry that payment is net cash in calendar days from date of invoice as
specified. Claims for defects, damages, or shortages must be made by the client
in writing no later than a specified number of calendar days after delivery. If
no such claim is made, the supplier and the client will understand that the job
has been accepted. By accepting the job, the client acknowledges that the
supplier's performance has fully satisfied all terms, conditions, and
specifications.
It is customary in the
industry that the supplier's liability will be limited to the quoted selling
price of defective goods, without additional charge for special or
consequential damage or as specified. As security for payment of any sum due
under the terms of an agreement, the supplier has the right to hold and place a
lien on all client property in the supplier's possession. This right applies
even if credit has been extended, notes have been accepted, trade acceptances
have been made, or payment has been guaranteed. If payment is not made, the
client is liable for all collection costs incurred.
Applicable Law
By visiting
Wetinkprinting.com, you agree that the laws of the state of California, without regard to principles of
conflict of laws, will govern these Conditions of Use and any dispute of any
sort that might arise between you and Wetinkprinting.com or its affiliates.
Disputes
Any dispute
relating in any way to your visit to Wetinkprinting.com or to products you
purchase through Wetinkprinting.com shall be submitted to confidential
arbitration in Los Angeles, California, except that, to the extent you have in
any manner violated or threatened to violate Wetinkprinting.com's intellectual
property rights, Wetinkprinting.com may seek injunctive or other appropriate
relief in any state or federal court in the state of California, and you
consent to exclusive jurisdiction and venue in such courts. Arbitration under
this agreement shall be conducted under the rules then prevailing of the
American Arbitration Association. The arbitrator's award shall be binding and
may be entered as a judgment in any court of competent jurisdiction. To the
fullest extent permitted by applicable law, no arbitration under this Agreement
shall be joined to an arbitration involving any other party subject to this
Agreement, whether through class arbitration proceedings or otherwise.
Attorneys Fees
In the
event Wet Ink Printing commences an action to enforce the provisions of this
agreement, the court shall award the prevailing party attorneys fees and costs.
In any litigation between the Client and Wet Ink Printing for fees provided for
in the contract, the party prevailing in the litigation shall be compensated by
the loser for attorney fees and court costs to recover fees.
